APPORTIONMENT of the RENT-CHARGE in lieu of TITHES PARISH of ORPINGTON in the County of Kent.

WHEREAS AN AGREEMENT FOR THE COMMUTATION of TITHES in the Parish of ORPINGTON in the County of Kent was, on the thirtieth day of June in the Year One Thousand Eight Hundred and Forty Three confirmed by the Tithe Commissioners for England and Wales, of which Agreement, with the Schedules therein comprised arid, thereunto annexed, the following is a copy:-

        A PROVISIONAL AGREEMENT for the Commutation of the Tithes of the Parish of Orpington in the County of Kent pursuant to the Act for the Commutation of tithes in England and Wales made and. executed at a Parochial Meeting of the Landowners arid Tithe-owners within the limits of the said Parish duly called and first holden therein and adjourned from time to time and holden by adjournment this twenty third day of November One thousand eight hundred and forty two and since perfected according to the provisions of the said Act By and between The Reverend Francis Dawson who as Rector of the Sinecure Rectory of the said Parish is Owner of all the Great Tithes and also of the tithe of Hops arising from and upon all .the Lands within the said Parish,
            And Samuel Hood Inglefield Esquire a Rear Admiral of Her Majesty's Fleet Charles William Hallett Esquire and William Parker Esquire his Lessees for lives of the said tithes at a yearly rent of less than two thirds of the clear yearly value thereof and. The Reverend William Townley who as Vicar of the said Parish is entitled unto all the other tithes accruing within the said Parish of the one part
            And The Several persons Landowners or Substitutes according to the provisions of the said Act for Landowners within the said Parish by whom or by whose Agents duly authorised in that behalf this Agreement is executed and the Interest of which Landowners in the Lands of the said Parish is riot less than two thirds of the Lands of the Parish subject to tithes of the other part
            The Parish of Orpington aforesaid, contains by admeasurement three thousand five hundred and. two acres two roods and fourteen perches of Land Statute Measure
            The whole of which is subject to the payment in kind of all manner of tithes except as hereinafter mentioned and is now cultivated or used as follows:

            A Water Corn Mill in the occupation of John Colegate is exempt from payment of tithe by prescription being an Ancient Mill
            The several pieces or parcels of Land specified in the first Schedule hereunto annexed are the Glebe of the said Rectory of Orpington and are subject to the payment of tithes when not in the manurance or occupation of the Rector himself.
            And the several pieces or parcels of land specified in the second Schedule hereunder written are the Glebe of the said Vicarage of Orpington and are subject the payment of tithes when not in the manurance or occupation of the Vicar himself.
            And it is hereby agreed that the annual sum of Six Hundred and ninety seven pounds fifteen shillings by way of ordinary rent charge (subject to the provisions of the said act) shall be paid during the Continuance of the said Lease to the said Samuel Hood Inglefield Charles William Hallett and William Parker their heirs and assigns and from and after the expiration or determination of the said Lease then to the said Francis Dawson if he shall then be holden of the said Sinecure Rectory and after the said Rectory shall become Vacant then to the Ecclesiastical Commissioners for England or to the person or persons lawfully entitled to receive the same instead of all the Great Tithes arising from all the lands within the said Parish of Orpington except the Glebes.
            And it is hereby further agreed that the annual sum of one hundred and seventy four pounds five shillings and sixpence by way of ordinary rent charge subject to the Provisions of the said act ) shall be paid to the said William Townley as Vicar and produce of Market Gardens Orchards and fruit plantations arising from and upon all the Lands within the Paris except the Glebes
            And it is hereby further agreed that the several further annual sum of Sixteen pounds four shillings in lieu of the Great Tithes and four pounds eleven shillings in lieu of the tithes other than of Hops and the produce of Market Gardens Orchards and fruit plantations shall be the ordinary rentcharges subject to the Provisions of the said Act fixed the said Rectorial Glebe Lands and shall be apportioned separately and exclusively upon the said Rectorial Glebe Lands.
            And that the Several further annual sums of four shillings and three pence in lieu of the Great Tithes and one shilling and three pence in lieu of the small tithes other than tithe of Hops and the produce of Market Gardens Orchards and fruit plantations shall be the ordinary rentcharges fixed upon the said Vicarial Glebe Lands and shall be apportioned separately and exclusively upon the said Vicarial Glebe Lands and that the same last mentioned four rent charges shall be respectively payable whenever the said Glebe Lands respectively shall not be in the rnanurance or occupation of the said Rector and Vicar respectively in the manner and to the persons following (that is to say).
            The said, rentcharges of Sixteen pounds four shillings and four shillings and three pence during the continuance of the said Lease to the said Samuel Hood Inglefield Charles William Hallett and William Parker their heirs or assigns and from and after the expiration or determination of the said Lease then to the said Francis Dawson if he shall then be Hector of the Rectory of Orpington: aforesaid and after that benefice shall become vacant then to the said Ecclesiastical Commissions for England or the .person or persons lawfully entitled to receive the same.
            And the said rent charges of four pounds eleven shillings and one shilling-and three pence to the said William Townley as Vicar of the said Vicarage and. to his Successors in that benefice
            And it is further agreed, that the additional sum of nine shillings per Imperial Acre and a proportionate sum for any quantity of Land less than an Acre shall be paid to the said Samuel Hood Inglefield Charles William Hallett and William Parker their heirs and assigns during the continuance of their said Lease and after the determination thereof then to the said sinecure Rector of the said Parish by way of extraordinary rent charge in respect of all Lands within the said Parish which now are or hereafter shall be cultivated as Hop Grounds so long as they shall be so cultivated                                                                                             Extraordinary Charge capitalised C.190
            And it is further agreed that the additional sum of seven shillings per Imperial Acre arid a proportionate sum for any quantity of Land less than an Acre shall be paid to the said William Townley as Vicar of the said Vicarage and. to his Successors in that benefice by way of extraordinary rent charge in respect of all Lands within the said Parish which now are or hereafter shall be cultivated as Market Gardens Orchards or fruit plantations so long as they shall be so cultivated                                                                            Extraordinary Charge capitalized C.190
            And it is hereby lastly agreed that the Lands in the said Parish shall be discharged from the payment of tithes (except as excepted in the said Act) from, and after the first day of October next preceding the Confirmation of the apportionment of the rent charges hereinbefore agreed on and that the first payment of such rent charges shall be made or be recoverable on the expiration of Six Calendar months from the time at which the said Lands are discharged from the payment of tithes. In witness whereof the said parties to this agreement or their Agents on that behalf duly authorised in their names and on their behalf have subscribed and set their respective hands and seals.

            AND WHEREAS a Separate award by way of Supplement to the foregoing Agreement was on the twenty first day of March in the year One thousand eight hundred and forty four confirmed by the said Tithe Commissions of which Separate Award the following is a copy

            TO ALL TO WHOM these presents shall come I JOHN MAURICE of Lincolns Inn Barrister at Law send greeting
            Whereas an Agreement commuting the tithes of the Parish of Orpington in the County of Kent for the several Rent charges therein specified has been confirmed by the Tithe Commissioners for England and Wales but the apportionment of the said Rent Charges has not been confirmed
            And Whereas it has been represented to the said Tithe Commissions that all the Glebe Lands of the said Parish are by prescription absolutely exempt from all tithes both great and small and that it is through error provided by the said Agreement that there shall be paid to the Rector of the said Parish and his Lessees and to the Vicar of the said Parish respectively the Several Rent Charges of Sixteen Pounds and four shillings and Four pounds and eleven shillings in lieu of the great and small tithes of the Rectorial Glebe Lands and the several Rent Charges of four shillings and three pence and. one shilling aim three pence in lieu of the great and small tithes of the Vicarial Glebe Lands
            And Whereas it has also been represented to the said Tithe Commissioners that, a piece of Land called Highland Meadow belonging to Sir Percival Hart Dyke Baronet and now in the occupation of Addis Jackson and also a certain other piece of land called Davil's Orchard belonging to the Reverend Alexander Platt and. now in the occupation of Mary Percival are erroneously mentioned and included in the Schedule of the Rectorial Glebe Lands annexed to the said Agreement and that a piece of Garden ground part of the said Rectorial Glebe now occupied by Nathaniel Ogle and containing two roods and ten perches is erroneously omitted in the said Schedule
            And Whereas it has also been represented to the said Tithe Commissioners that the amount of extraordinary Rent Charge payable in respect of the Orchards and. Fruit Plantations of the said Parish is by the said Agreement erroneously and contrary to the provisions of the lets for the Commutation of tithes in England and. Wales distinguished from the amount of Ordinary Rent charge agreed to be paid, to the Vicar of the said Parish by reason of which said several errors and omissions the said. Agreement would be unjust and such errors and. omissions had been made known to the said Tithe Commissioners previous to the Confirmation, of the said Agreement they would have declined to confirm the same or would have caused the same to be varied previous to such confirmation 
            And Whereas the said. Tithe Commissioners have duly-appointed me an Assistant Tithe Commissioner according to the provisions of the said Acts and have also appointed me to enquire into the said alleged errors and omissions and if necessary to make a Separate Award by way of Supplement to the said for the correction thereof
            Now Know Ye that I the said John Maurice Herbert having attended .a public Meeting of the Landowners and. Titheowners of the said Parish pursuant to Notice duly given and having at such Meeting satisfied myself of the truth of the said allegations do hereby make this my by way of Supplement to the said Agreement that is to say
            I do hereby find and Award that the said Rectorial and Vicarial Glebe Lands are all and every of them absolute exempt from all tithes both great and small And that no sum or sums shall be paid to the Rector of the said Parish and his Lessees or to the Vicar of the said Parish in respect of the said Glebe Lands or any of them, as specified, in and provided by the said Agreement.
            And I do hereby further find and Award that the said several pieces of Lands called respectively Davils Orchard and Highland Meadow are not nor is either nor any part of them, part of the said Rectorial Glebe Lands and that the said piece of Land herein before described as in the occupation of Nathaniel Ogle is part of the said Rectorial Glebe Lands
            And lastly do hereby Award that there shall be paid to the Vicar of the said Parish for the time being by way of Rent Charge and subject to the provisions of the said Act the annual sum of  Two hundred pounds in lieu of all the small Tithes of the said Parish and also instead of the Ordinary Rent Charge of One hundred and seventy four pounds five shillings and six pence and the Extraordinary Rent Charge of seven shillings per acre mentioned and set forth in the said Agreement.
            In testimony whereof I have hereunto set my hand, this thirteenth day of March in the year One thousand eight hundred and forty four.

            And Whereas notice in writing under the hands of certain owners of Orchards and Fruit Plantations within the said parish of Orpington lieu whose Interest therein is not less than two thirds of the whole of the Orchards and Fruit Plantations in such Parish, hath been duly given to the Valuer by whom the written Apportionment is made that the tithes thereof should be distinguished into two parts.

            NOW  I  JOHN STAPLES

of the Parish of Sutton at Hone in 'the County of Kent having been duly appointed. Valuer to apportion the total Sum Agreed and Awarded to be paid by way of Rent Charge in lieu of Tithes, amongst the several Lands of the said Parish of Orpington DO HEREBY apportion the Rent Charge as fellows:
            GROSS RENT CHARGE payable to the Titheowners in lieu of Tithes for the Parish of Orpington in the County of Kent:
