The first part of this Will is written in Latin
Anno 1504. Thomas Smyth of Hersmonden (Horsmonden).
Names and places mentioned include: St Margarete of Horsmonden,
Gift to bridge of Brodeford 40d. Gift to Johi Baron vjd.
Wife Alicie, Sons Johi, Willmo and Stephan.
Exors Johem (son), Nichm Smyth.
This is: upon a feoffement made to John Courthope, Nicholas
Smyth, John Atkyn and Wm Duke of and in all my londs and tenements
the whiche I have in the parisshes of Horsmonden and Goutherst. I will that
John my sone divide all my said lands etc. into two severall partes and than I
will that Stephen my sonne shall have his choise to chose oon of them. I will
my forsaid feoffes shall make a state therof to him in fee simple under
condicon that he pay to Wm my sone xjli of laufull money
of England that is to say within a yere ls and so yerely every yere
after ls unto the sume of xli be fully content and paid
and then in the next yere xxs in full payment
Also I will John my sone have that other part so devided and my
said foeffes make to hym a state in fee simple under condition that he pay to
the forsaid William my sone xjli in maner and forme as the forsaid
Stephen my sone shall pay his xjli. (In default of payment feoffes
to divide into three parts and Wm to have the third part). [No day
given in date].
